Bihar Assembly Election 2020 Schedule District Wise

The Bihar Election Watch and Association for Democratic Reforms (ADR) has analysed the self-sworn affidavits of 1064 out of 1066 candidates who are contesting in the Bihar Assembly Elections Phase 1. After analysing the affidavits, ADR found out that out of these 1064 candidates, 328 (31%) of them are with Criminal Cases and 244 (23%) of them are with serious criminal cases.

If we follow the same data for the major political parties, then out of the 41 candidates from RJD who are contesting in the first phase 30 of them have criminal cases. Similarly, 21 out of 29 candidates from BJP have criminal cases. 21 out of 41 from LJP, 12 out of 21 from Congress, 15 out of 35 from JDU, and 8 out of 26 from BSP have criminal cases.

Talking about the candidates from major political parties with serious criminal cases, then, here also RJD tops the list, with 22 out of 41 candidates having serious criminal cases. LJP holds the second position in the list with 20 out of 41 candidates having serious criminal cases. BJP at the third with 13 out of 29 candidates. The next is Congress with 9 out of 21 candidates. Then, JDU with 10 out of 35 candidates, and the last one is BSP with 5 out of 26 candidates having serious criminal cases.

Out of all the candidates contesting in Bihar Assembly Election Phase 1 (October 28),

  • 29 of them have declared cases related to crime against women, in fact 3 of them have declared cases related to rape (IPC Section-375 and 376).
  • 21 candidates have declared cases related to murder (IPC Section-302) against themselves.
  • 62 candidates have declared cases related to Attempt to murder (IPC Section-307)against themselves.

The Importance of Form 26

Those of you who don’t know, a candidate contesting for election in India have to file an affidavit called Form 26. In Form 26, the candidate has to mention his/her assets, liabilities, education qualification, criminal antecedents (convictions and all pending cases), and public dues.

The main aim behind introducing Form 26 in election is to help candidates make informed decisions after noting the criminal activities of a candidate.

Bihar Assembly Election 2020 Phase One 86 percent Red Alert Constituencies

Red Alert Constituencies are those where 3 or more contesting candidates have declared criminal cases against themselves. So, out of 71 constituencies situated in 16 districts for which the voting will be done in the first phase, 61 of them are Red Alert Constituencies.

Supreme Court Directions had no effect on Political Parties in selection of Candidates

Back in February 13, 2020, Supreme Court instructed the political parties to give reasons for selecting candidates having criminal antecedents in place of those candidates who have a record of good social work, and who are politically motivated. Regardless of what Supreme court instructed the political parties they have no interest in reforming the electoral system and hence our democracy will continue to suffer at the hands of lawbreakers who become lawmakers.
